General Terms and Conditions of Tennisakademie Post SV

1. Scope

These General Terms and Conditions apply to all offers and services of Tennisakademie Post SV as well as the website www.tennisakademie.wien and the social media channels of Tennisakademie Post SV.

2. Training

Our offer includes individual, group and team training. For didactic reasons, group training is carried out with groups of between 2 and 5 players. Larger groups are only taught in special circumstances, e.g. toddler groups, school classes, summer camps, etc. Tennisakademie Post SV divides the groups according to practical necessities, in particular playing strength and age. Tennisakademie Post SV tries to take the wishes of the customers into consideration as far as possible.

A booked group training is not transferable without the express consent of Tennisakademie Post SV. The customer is not entitled to have training sessions with specific trainers. However, Tennisakademie Post SV endeavors to comply with the wishes of the customers regarding a specific trainer.

3. Training Costs & Duration

One training unit comprises 50 minutes. If a training unit has to be cancelled after 25 minutes due to weather conditions, this counts as a full training unit.
Unless another payment date has been agreed in writing on the invoice, the training costs are to be paid after invoicing before the start of the course.

If the course fee is not paid on time after a reminder, Tennisakademie Post SV reserves the right to exclude the customer from the current course until payment has been made. The customer is not entitled to make up for the hours missed during the exclusion.

In the event of a delay in payment of more than 20 days, Tennisakademie Post SV is entitled to charge reminder fees of €5 for an invoice amount up to €100, €10 for an invoice amount up to €1000, and €20 for an invoice amount from €1000.
In the event of default in payment, all dunning and collection expenses, in particular also pre-trial legal dunning costs, shall be reimbursed. For each reminder issued by KSV 1870, the latter and Tennisakademie Post SV will charge the customer reminder processing and postage costs.

The court costs included are paid by Tennisakademie Post SV to Postsportverein Wien as a pass-through item.

4. Cancellation Conditions and Missed Hours

Free cancellation of a season course is only possible up to one week before the first training session. If the course is cancelled less than one week before the first course unit, the course fee will be refunded less a cancellation fee of 50 percent of the original course fee. Ongoing courses cannot be cancelled, there is no entitlement to a refund of the course fees.

If a customer is unable to attend the course for a longer period (at least 6 weeks in a row) due to illness or an accident, the missed hours will be refunded upon presentation of a medical certificate.

5. Missed Hours

If agreed training dates cannot be kept, the customer must inform us immediately, but no later than 24 hours before the date. Otherwise, our obligation to perform ceases to apply. Tennisakademie Post SV retains the right to the training fee.

In the case of individual lessons, there is the possibility of making up the training unit at a replacement date after timely cancellation. In the case of group training (3 or more people), individual players in the groups can make up for the missed training at a make-up date specified by Tennisakademie Post SV, if they cancel in time.
Customers who participate in group training (3 or more people) will not receive a partial refund of the purchase price or a credit of a partial amount if the lesson(s) they missed were held with other members of the training group. This also applies if the individual customer cancels 24 hours or earlier.
It is also possible for the entire group (e.g. group of 2) to postpone a training date and make it up on a replacement date. A maximum of one replacement date is possible per playing season for a unit cancelled in good time. A training hour that is not made up during the current season will expire.

In case of rain or unplayability of the courts, missed hours will be made up. In this case, Tennisakademie Post SV will inform you about the cancellation of the training on the website www.tennisakademie.wien in good time. Hours cancelled by Tennisakademie Post SV will of course be made up.

6. Supervision of Children

Our duty of supervision for minor children is limited to the duration of the training. We cannot assume any duty of supervision before the start and after the end of the training. The parents/guardians must therefore ensure that their child(ren) are brought to us on time and picked up again on time after the training.

7. Exclusion from Training

We reserve the right, in individual cases, to exclude training participants from a group or training if they do not follow the instructions of the trainer despite being warned or disrupt the training. Parents agree that in such a case their child must remain in the training area until they are picked up. In this case, the excluded person is not entitled to a refund of his/her (proportional) training fee.

8. Warranty

Complaints due to deficient and/or missing performance of Tennisakademie Post SV or any damage to persons or during a training session must be reported in writing to Tennisakademie Post SV within 72 hours after this training session. After this period, the performance of Tennisakademie Post SV is considered approved.

9. Data Protection

Your personal data is stored electronically by us. It will not be passed on to third parties. Customers of Tennisakademie Post SV are included in our e-mail newsletter. This newsletter is used to provide information about course offers, tournaments and events of Tennisakademie Post SV at irregular intervals. The sending of the e-mail newsletter can be revoked at any time.

Tennisakademie Post SV reserves the right to use any image and video material recorded during training or events of Tennisakademie Post SV for the purposes of Tennisakademie Post SV. This includes use on the homepage “tennisakademie.wien” and the social media presence of Tennisakademie Post SV. If the use is not desired, it can be revoked at any time.

10. Liability

Tennisakademie is not liable for injuries or accidents during tennis lessons, unless these were caused intentionally or through gross negligence. Attendance at training sessions is at your own risk. The customer is liable for damage to the training material caused by him.

11. Final Provisions

Austrian law applies. The competent court is the Bezirksgericht Hernals or, depending on the case, a higher Austrian court.
